Bail Commissioner

Previous Newport County Bail Commissioner

Prosecutorial & Judicial Experience

My prosecutorial experience began in April of 1994 as the Assistant Solicitor for the Town of Little Compton. In that capacity my duties included prosecuting misdemeanors that occurred in the Town of Little Compton such as domestic violence and drunk driving. I continued as Assistant Solicitor for 14 years during which time I began to serve as Assistant Solicitor for the Town of Portsmouth in December of 2002 where I handled similar misdemeanor prosecution cases. Additionally, in the Towns of Burrillville, Middleton and Portsmouth I served as Special Prosecutor, again for misdemeanor cases involving drunk driving and domestic violence.

Through these experiences I was able to establish a strong working relationship with the law enforcement communities in several areas throughout the State of Rhode Island. In addition it allowed me the specialized opportunity of handling criminal cases both as a prosecutor and a defense attorney. From this all-encompassing vantage point I have been able to level the playing field and obtain excellent outcomes for my clients.

In August of 1996 I began practice as a Newport County Bail Commissioner, the service of which has allowed me to play a crucial role in our judicial system. As Bail Commissioner I have several vital responsibilities including:

  • To act as neutral magistrate at initiation of criminal proceedings
  • To make probable cause determinations
  • To sign arrest warrants
  • To commit individuals to the Adult Correctional Institution

In December of 2003 and continuing through December of 2005 I had the opportunity to serve as the Municipal Court Judge for the Town of Tiverton. While serving as Municipal Court Judge I heard and decided cases of local minimum housing, standard traffic violations and zoning issues.

"I highly recommend him because of his professionalism and dedication to his clients and their families."
Earlier this year, I received the call that every parent dreads, the police informed me that my son and his friend had been in an accident involving a utility pole. Fortunately neither of them were seriously injured but my son was charged with OUI. I contacted a family friend who is a lawyer in Rhode Island and he referred me to Robert H. Humphrey, Esq. This was a long and difficult process for our family, appearing several times before the Attleboro District Court, but based on Bob's arguments, the Judge agreed to dismiss the OUI charge. We really appreciate everything Bob did in researching the scene of the accident and the law regarding OUI cases. I highly recommend him because of his professionalism and dedication to his clients and their families.

I wanted my day in court and Attorney Humphrey expertly prepared my DUI case for trial. Due to Attorney Humphrey's skill and experience I was found not guilty after trial and I never lost my license. Because of Attorney Humphrey I was able to keep my job.

"We could not be more pleased with the end result."
My son and I want to thank you and Attorney Petta, for the successful resolution of our matter. When he called from school and told me about the alcohol possession charge, I knew we needed to seek legal representation. As we are not from the Bristol area, and not familiar with local laws, we really did not know where to begin. I was fortunate to come upon your website, and it was clear your office was experienced with cases far more serious than his. I was surprised to reach you in person when I called for a consultation, and you quickly put me at ease after discussing the situation. We could not be more pleased with the end result.

"My parents and I were extremely pleased with the outcome."
My parents and I did not know where to turn after I was arrested by the State Police and charged with drunk driving. I am a college student and had been involved in an accident and feared the worst possible outcome. I was referred to Attorney Humphrey and he achieved what I thought was impossible. Even though I had high readings, the charge was amended to reckless driving and I did not receive a criminal conviction!!! My parents and I were extremely pleased with the outcome.

"I am extremely grateful for your professional handling of my daughter’s case."
I am extremely grateful for your professional handling of my daughter’s case. We are really fortunate that we had someone of your ability representing our daughter in her case. In our wildest imagination I don’t think we could have hoped for the outcome we were able to achieve. When I first received the call at 3:00 a.m. on Saturday I feared the worst. When we arrived at the police station I was horrified to read the report. Not only had she blown a .186 on the Breathalyzer, she was also cited for speeding, having too many people in the car, all of whom were unrestrained, and even one individual riding in the trunk. We knew she was in serious trouble. Her mother and I didn’t know what to do. We knew we couldn’t allow her to go into court on her own without some sort of representation. Reading the report, I thought it really wouldn’t matter who we had representing her because of the charges against her all of which seemed accurate and indefensible. We were especially lucky to have found you on the Internet. Your knowledge of the court system and process along with your expertise made us feel much better going into this. The fact that you were able to get the result you did was remarkable. I would strongly recommend you to anyone who finds themselves in a similar situation. If someone makes the same egregious mistakes our daughter made, I would strongly suggest that they call you immediately and ask you to take their case.
